Obama`s 287(g) Could Reduce Gwinnett`s Options

immigration signThe most active 287(g)-trained Sheriff’s Department in the country, Davidson County, Tennessee, has been told by the Obama administration that Immigration and Customs Enforcement (ICE) will no longer pick up every illegal alien from its jail. Instead, the S.O. has been told to release minor offenders back into the wild, where they will no doubt disappear and fail to return for a court date.

According to news accounts, earlier this month ICE issued a directive to one of the most productive 287(g) jurisdictions to cease holding many of the illegal aliens arrested by the sheriff’s officers, and instead release them back into the community…. Now, only a fraction of the thousands of illegal aliens they arrest in Davidson County, Tenn. will actually be removed. The rest will be released on their own recognizance (“O.R.,” or “down the road,” as the expression goes) and told to appear in immigration court at a future date. ICE knows from experience that fewer than 15 percent of illegal aliens released O.R. will show up for these hearings. [Full article]

The change in policy follows a report by the Government Accounting Office in which the program’s application was questioned. Apparently, 287(g) was never intended to process all illegal aliens incarcerated by trained local cops; only the most violent or repetitive offenders.

The change will most likely spell doom for Gwinnett’s effort to join the program and begin deporting the hundreds of illegal aliens that pass through its jail’s doors each month. Even if Gwinnett is accepted, only a fraction of eligible arrestees will eventually be processed and deported.

My solution remains the same as it was in March of this year and in October 2008:

  1. Check the citizenship status of all business license applicants, not just sole proprietors;
  2. Check the citizenship status of all license renewal applicants;
  3. Require Gwinnett cities to obey the Georgia Security and Immigration Compliance Act, a state law;
  4. Require all business license applicants to prove enrollment in E-Verify;
  5. Prohibit the harboring of illegal aliens;
  6. Issue an occupancy license;
  7. Adopt a policy of full cooperation between the county and federal agencies and an ordinance prohibiting “sanctuary cities;”
  8. Aggressively enforce the property maintenance ordinance;
  9. Require the recipients of any public monies to obey state and local immigration laws;
  10. School system must verify citizenship eligibility for public benefits

    I agree with you on all your points, but I doubt that the county will do anything at all. My cynical side keeps whispering to me that our officials purposefully waited until 287g was gutted before signing on. Business owns government, and business loves cheap labor.

    I, on the other hand, would gladly triple my property tax bill if the county would throw out the illegals and keep them out. If the illegals leave, then the cartels lose their cover and our schools can begin teaching English comprehension, not English as a second language. Given our leadership, I think it is FAR more likely that I will leave instead.

    Gwinnett needs me more than I need it. I moved here (mistakenly, I think) for my family. I’ll soon move out for the same reason.
